We bought some land in Missouri from a relative and after living on the property for over 20 years we found out the whole house isn't even on our property. It was bought from a family member and they refuse to grant us the land. Is it possible to get the land and the house? I'm sure it will be costly, what are your recommendations?

Grandfathered in? I hope the attorney is a REAL ESTATE attorney! The land under the house that seems to not be yours may actually be considered abandoned by the original owners if there was no rent paid???? Also there is usually a law that covers squatters rights. When someone who doesn't own the property moves in and improves the property and lives there for a number of years they have a claim to the property. The attorney should be able to get you through this one without to much trouble. Good luck with it.

Two questions for you:

1) Did you get a survey?

2) Did you get an attorney to search the title, draw up a Deed, and get title insurance?

If you had done both (and it sounds like you didn't), fixing the problem wouldn't be an issue because your title insurance would have paid any and all expenses to fix it.

I have no idea of how to advise you other than getting an attorney to fix the mess is critical to fixing it.
