I have a one year rental agreement that states that I am to make monthly payments of $XXXX amount, but it doesn't say anything about what day of the month each payment is due by. For instance, I made the monthly payment for August before the first of August. What I'm wondering is if I have to make the payment before the first, or the second. If there is no time stated for when a payment is considered late, can I make the September payment at any time during September without being in breach of the contract.

usually they are due at the first of the month and most of the landlords give you about a week after that for a grace period before the consider it late.

Typically rent is assumed to be due on the first of the month unless the rental agreement states otherwise. I would really make sure your rental agreement doesn't say anything about late fees or default for late payment before you try to pay rent later than the first.

You should probably have you lease looked at by a real estate attorney

Usually these things are spelled out in your written lease. It is customary that the rent is due before the first of the month It is considered late if it is late one day. If you are a good tenant, pay on time, clean, do not damage premises, do not disturb the peace (illegal activity), violent behavior, loud noise, you are not in breach of the lease. Many rentals have a list of rules (like no storage in the hallways). Most leases have a penalty on a payment more than five days late. Your landlord would not want to evict you for being one day late, unless he wants to get rid of you.

Be very certain the dates are NOT in the contract, before you make a payment past the 15 of the month. Most payments are due on the 1st. Late would be the 15th.

You are funny. ha ha. Even when the contract doesn't state the date. You signed a contract for $XX a month. In a month there are certain amount of days. You need to pay every 30 or 31 days or it is late. So if you paid one month on 8/1 then you owe it by 9/1. It seems like you have a contract that says, we trust you...so don't mess with it and prove them that you ARE trustworthy. Believe me, if you are late, they will let you and your creditors know...don't risk it.

Rental agreements are more than likely for the first of the month. Unless stated otherwise in your lease, I would pay before the first.

Most leases are due on the 1st, if nothing else then every month on the same day as you signed your lease.

My leases are always due on the 1st and late on the 6th, if you move in during the month, 1st months rent is prorated for the rest of the month and thereafter rent is due on the 1st.

Generally, rent payments are due on the first day of the rental period. The lease will tell you if there is any "grace" period, and what the penalty for going beyond that period would be.

Typically the rental agreement has a start date. I would think that would be the date the rent is due every month.
