hello, my girl works at Pea in the Pod a high end clothesline for pregnant woman/maternity. She's been with the company for about 2 or more years.... she was recently shoved/push by her assistant manager (she was 4 months pregnant at the time) while she was trying to obtain corporate office phone number. She has been trying to contact corporate office to inform them how her assistant manager has been "bullying" her. The corporate office promised to resolve this matter...and promised to not have them work together...its been 2 months and they are working together again and they are constantly arguing.... the manager of the store encourages my girl to file a law suit....she has two written statements of how the assistant manager pushed my girl, some clients witnessed it and a co-worker....

Sounds like your girl has enough independent corroboration to prove her assertions, so I'd advise her to get a lawyer and have the lawyer write to corporate and tell them they have 30 days to fire the assistant manager and issue a full apology to your girl or she takes them to court. Heck, she might decide that's too nice (and I wouldn't disagree) and have the lawyer file suit right away. In either case, if everything you've said here is true your girl has a solid case.

Make the store manager a happy camper and FILE THAT LAWSUIT !! If your daughter has witnesses that are willing to testify ........... or sign those statements , she can`t lose !

Once the lawsuit is filed , contact the corporate office and advise a the lawsuit has been filed "on the advice of the assistant manager" !!

Once corporate headquarters gets their copy of the statement of claim ............... the assistant manager will be toast ..... and they`ll probably want to settle out of court with your daughter .

If they want to settle out of court , get and keep everything IN WRITING ............... signed and dated ......... otherwise the settlement won`t be worth the time of day !

If the corporate office won't handle it, your girl needs to get an employment and personal injury attorney. This manager went from bullying and harassment to assault. Next time your girl gets shoved, she needs to call the police.

Sounds like time to hire an attorney. She needs to make sure she has her witnesses statements in writing with her when she sees the lawyer.
