Okay...when I was 4 mths pregnant, moved to georgia with my sons father....he was getting abbusive and he was very controlling and jelouse...wouldn't let me have friends, get a job stuff like that...when the abuse got worse, he had pinned me up against the fridge by my throat with my 4 mth old in his hand...thats when i knew I had to get out...so the next day I went into a domestic violence shelter and stayed there for 2 nights and then my mother came to ga and we moved back to florida....I got served papers on friday 8/17/07...I talk with my attorney (bay area legal services) 8/27....I have 30 days to respond...but in the mean time...i was going to bring him to georgia for labor day weekend to see his side of the family but he is being so mean to me...he gave me 60 dollars and is saying im being selfish keeping him to myself and running with him, taking him away from him and his family....i am scared of him but we would be at his moms house...oh i never called the cops..

You need to keep your distance from him. Don't do anything that you don't have to do. Since the child is so young the jugde should give you custody as long as you cannot be proved "unfit". You need to get an Ex parte. Whoever gets that first will have sole TEMPORARY physical and legal custody of the child until the court date is set. Yes he can file that too. Be careful and quick. In the final papers I'd be careful how it is worded. You don't want him to be able to run with the baby. If you want to know anything else, email me. DON'T GO!!! regardless of what he says. Abusive people will say anything and do anything to control you. You fight back, its your choice to stay or leave, but going for a visit could land your name on the 6 o'clock news. Be smart for your child, stay away until all of this is legally taken care of. And definitely fight for full/sole custody with only monitored visitation. Tell the courts that you fear for your life and that of your child. And that you fear he may try to kidnap as a way to continue to control you.

Since you never called the police, there is no record of abuse - so that can't be used in court.

He probably won't get full custody, however, if you haven't established residency in FL yet (lived there 6months) , you could be forced to move back to GA and he can get joint custody up to 50%.

If you are scared of him why would you put yourself and your child in an abusive situation. If he wants to see his son he can visit on your terms

first play tit for tat, file for child support... and no judge will give him custody if you can prove u have a stable environment to raise the child in...

you need to be asking your lawyer what to do; meantime find out about a restraining order, but ask your lawyer first
