I want to sell some gifts in a large tourist site that is synonymous with a structure that dominates the location - like the Eiffle tower but its not that one. can i take a picture of "the tower" to use that example get graphics made up and sell " Eiffle tower" chocolates or "Eiffle tower" beach towels etc?

A difficult one. The intellectual property of the landmark may remain with the owners, despite your own photo, and they may take exception to you profiting from its use - preferring to market their own products. I suggest you consult a solicitor or barrister who specialises in intellectual property to clarify the situation. Better than landing yourself in court.

Roxy (above) is correct -- there are potential trademark issues if someone else has intellectual property claims to that symbol.
