I have rented this house for 4yrs. I pay $1075.00 a month the A.C.dont work there are no screens in any windoes and my elec.dont work in the basebent and the in door pool they said they would fill in, is now a swamp.Now they want me to pay and dig the hole to have the ceptec tank clean and cut down all the trees around the propan tank so it can be painted.what should I do?

I signed a one year the first yr. and they never had me sign a lease again.

You need to give a list of all the problems with the home to your landlord. Tell him which ones you want fixed and by what date. If it is not done you will move or he will need to lower your rent. You can give him one of those two options.

If you have a two story home with no screens it is a safety issue and the housing authority will make him buy the screens in order to rent out the home. The same with smoke and fire detectors. He must have a certain number in the home to be legal. That number depends on how many rooms and the square footage of the home.

The landlord can not require you to dig a hole or cut trees that is his responsibility and you MUST tell him so. If he pushes you push back and tell him you will get your attorney involved. He should back off right away.
If you really wanted to close him down, get the City or County Home Inspector to come out. Indeed they will find violations and make him fix up the place. But if you do, be prepared to move as they can declare it unfit.
Do not Pay or Take Care of the Landlords responsibilities.

First of all as a tenant your not responsible for the property other then maintaining it as it was. By this I mean not beating the walls to pieces etc. It's not your responsibility to fill in the hole or to have the septic cleaned. And definitly not to have the trees cut down. Unless of course when you signed the lease It stated you were responsible for such things.(Which I doubt). Anyway where he/she hasn't had you renew your lease after the one year you automaticaly switch to a Month to Month lease, Meaning you only have to give your thirty days notice. I know all this because I've delt with many landlords, thank god I own my own house now. Also If your having problems it's a good idea to check with your rentalsmens office and see what your rights are exactly. Good Luck.

If you don't have the option to move, start documenting the living situation and neglect by the landlord, then file a claim with your housing authority.

Landlords have the responsibility to maintain the home in suitable living standards, "habitability standard," With the poor electrical, hazardous indoor pool, no air conditioning, no window screens, etc, it does not sound good.

If they attempt to evict you after reporting them, you have a claim for retaliatory eviction.

Given everything you mention, you will win. But it depends on if you want to take on this effort.

Take him to small claims court. Take pictures of all the damages, get estimates from repair guys about the electrical and window situations. Try and get records of when and how many times you called him regarding fixing these various things. This way you will have an air-tight case and most likely you will either get all these repairs made or you will get a cash settlement and you can move out with it! Good Luck!!

What does your contract say? Did you agree to perform maintenance or maintain the premises in the same condition as when you moved in?

If you did, you may be legally liable for cost even if you move.

Take your contract to your local legal aid center and ask them to review it and give you advice that won't get you into more debt or prevent you from finding a new place to rent.

Either move because he sounds like a slum land lord or
report him to the proper authorities who handle these things.
I*m thinking the local police dept could at least tell you who to report him to, The trouble is taking him to court and going through all that is still going to take time and you will still be without the things you want.. I would move out and then give notice; Let him sue you for the last months rent. I doubt if he woule want to go to court.but he woould try bluffing.Refuse to pay for anything extra other than your rent. until you move

You are living without a lease?You need to talk to him,those are maintenance he is responsible for.How big are the trees he wants cut down?Talk to legal aide and show someone the swamp...Be careful rent can go up without a lease.Everyone needs A/C find out your renters rights where you are..

You should move but take pictures of all the bad things and make a list of all of it. The landlord will try and pin all that on you and put it on your credit report if you dont pay it.

Well, being a landlord, I can tell you that it's not your responsiblity. You should not put your own money into a rental house. I would probably just move.
