I have downloaded a few older ones from the 80's thats no longer available in shops.

The only way that it would be legal to download music that has been out of print so long that the original musicians and songwriters have been dead so long that the songs have passed into the public domain. Anything before is still protected by copyright law. Downloading from the iTunes music store would be the best bet to find all the old music you want because it's the online music store with the best selection and you would be downloading legally.

Short answer is, "Yes".

Copyright lasts for 50 years after the death of the copyright holder, when it passes into public domain. This can be extended if someone else buys the copyright.
