It entirely depends on four things, assuming the chracters are the same level.

The first is character equipment. Equipment quality is always a factor in PvP. Epic or better equipment is a serious advantage against someone who is mostly using green gear. Espetially if it is class specific gear with the right knid of bonuses. This also includes things like possion of potions and healthstones and the player's willigness to use them.

Seond is character build. Several Warlock builds that do very well in PvE combat have no effect whatsoever in PvP. Another build, however, gives the Warlock (a caster class) several instants and faster casting times.

The third is character situation. Is the chracter equiped and ready for PvP? Is this a duel, battlegorund, or PvP out in the gameworld? This is a combination of equipment and skill set-up. Many players actually have a two sets of equipment, one with bonuses to their PvE skills and another for PvP. This is espetially true of the warlock, since the Warlock's current pet has a large impact on their playing style.

Lastly is player skill. The skilled player can over come many of the previous advantages with skillful use of a character's skills and talents. Espetially when to and when not to stealth, and the use of Fear.

I've seen it go both ways. That being said, the rouge's usually win duels and most gameworld attacks in my experience. The Warlock's inablity to move and use most of thier spells at the same time is a hard disadvantage to overcome in a one-on-one combat. Espetially since most out and about warlocks use their tank pet; which is almost useless in PvP combat.

A PvP ready warlock has several instants though, allowing them to do damage while staying out of a rouge's reach, and a skilled warlock of sufficent level can keep a rouge out of reach with liberal uses of Fear and Charm from thier pet sucumbus.

well also i think that if a rouge got the lock by surprise he could do major damage because the lock wears cloth sooo his armor wouldnt be very strong against all of the rouges attacks

If it's a random world gank, I would say rogue, but it honestly depends on the skill. A good rogue can take a bad lock and vice versa. If they were equal in skill and neither had the surprise I would say the lock with fear spamming.
