Well I am fully aware of the cracks, but like kys said if she sign any property over to him I feel I have the right to keep the car it's not being selfish or nothing like that, I be dam that she would get that car that I helped pay off for. The car is paid off and everything on the car in the car is insured in my name rims sound system, etc.. Some of you have good advice and I know I should have had that title change but shiit happens and I will fight for whats mine no matter what,, also thanks to those for you sympathy...

Using your husband's name sign the title over to you and get a new title. That is the simplest and cheapest thing to do. You could hire and attorney and go to court and for $1,000 do the same thing. However, that is not necessary unless your husband or his estate sues you and that is not likely.
That is what most people do in similar situations. Years ago, a women had a large check made out to her deceased husband. She could not cash the check until the banker told her that if she if she signs his name and her name he could cash the check. That is what she did and there was never any problem.
In some states, you may have to have the signature notarized. If so notarize it as Mrs husbands name.
If you are one ot the paranoid women that thinks the world will come crashing down, then just keep driving and titling the car until it become worthless or until you decide to trade it. Explain your problem to the car dealer and he will take care of for you.
Edit: Since you have the divorce decree take it, the death certificate, and your marriage license to the title agent and get it titled in your name.

The divorced wife is responsible for anything should someone be hurt in the vehicle so technically the car is hers. If I were her thought I would just sign off on it now. Why would i want the car if i didnt want him anymore?
Worse case scenario she wants the car-give it to her and move on but if there is a car note associated with the vehicle she will be responsible for it and again would need to properly insure the vehicle
BTW please accept my condolences on the loss of your husband

Div wife accidently has name on title? She does the right thing and signs the title over to the current spouse.
Why would you want to stick your nose into that kind of behive? Just sign it and go, you have your own life to worry about.

Look in his divorce decree. It should be stated that he gets possession of the car. If yes, then it defaults back to you with NO worries. If it becomes an issue, don't release the car until you take her to court. Take the title to court with you and if she shows, ask the judge that she sign the title over while in his presence.
Meanwhile, try to get the title signed over by her ASAP.

the person whose name is on the title of the car is the legal owner. it doesn't matter who has driven the car, who kept the insurance, or any of that. and you can't give something in a will that doesn't "rightfully" belong to you. like, if I drove a car that belonged to my mom, I can't leave it to my boyfriend if I die. once I die, anyone can come in and take possession of their belongings as long as they can prove they legally own it. that's why it's important to have all of your ducks in a row after divorce. also, make sure you have an amended will should something happen to your partner. good luck!

The car is yours. It belonged to you before he died and it belongs to you now. The name on the title of ownership of the car is the owner. You may have to present the title in court for proof that it's your property, but there shouldn't be any problem after that. Take what belongs to you.

Depends on whats in the settlement agreement. If its in his agreement that he keeps it, then it would be yours. You would just have to prove that. If there is nothing that proves it, it would then become here. Although, you may be able to get a lawyer to fight for it? I'm not really sure.
