Correction, I am the one who is not yet prepared to get married, so i just want to ask if its possible that the court will allow us to change my daughter's surname without requiring us to get married?

You should talk to a clerk of the court in your home county / shire. Exactly what you do depends on the country and province you are in.

If the bio. dad doesn't want to marry you "now", that means he never will. He just hates to make you cry while you are still servicing him. Once he finds someone younger, prettier or with bigger breasts he will leave you behind. Your daughter will feel funny living with you and your new boyfriend of the year if his name is Jones, yours is Miller and hers is Smith.

This is one of those matters that should be taken care of only after the marriage vows have been said. You would be jumping the gun to change your daughter's name at this point in time. It may seem like a show of support that you actually will want to get married in the future and you're willing to even change your daughter's surname to prove it, but don't do it. You never know what the future will hold and there will be plenty of time for changing names afterward.
