her mother says she does not believe her daughter. although her mother has left her boyfriend in the past for abuse and even filed a restraining order against him. she dropped the restraining order the next day. she refuses to let his daughter come live with us. she knows her situation is bad neither her mother or boyfriend work and they have a convicted felon living with them on house arrest. also last year her mother made her miss 23 days of school. her mothers boyfriend is an alcoholic too. we called the police and they made us give her back to the mother because he only has joint custody. we filed emergency custody and seeked an attorney. does anyone know what happens in an emergency custody hearing and who all has to be present? based on the info i gave you do you think this is enough for her dad to get custody? any advice and help would greatly be appreciated. also, we called CPS and they did nothing.

there is prrof when the mother filed a restraining order she reported abuse and then dropped the restrainig order and moved back in with him.

1. Take pictures, Show even the slightest bruise, scrape, Vidieo/audio tape (with out baby girl knowing), when sh's in a talking mood. But protect her from these MONSTERs!!!! Put him in prison for a long time!! Hire a P.I. to catch the dirt or him, we daddy's, sometime over react, and hurt r case!! GOOD LUCK GOD BLESS

You need good solid proof that this is happening. Check his daughter for bruises etc take photos. The Police already have a file of his previous abuse so you might be able to get a copy.

Keep on at CPS until they do listen to you.

If you called CPS and everything you told is true, they would have done something. Get proof, it sounds like a nasty battle axe if you have no proof of what you are saying. Get the girl away from the mother so you need to have no further contact? Get proof if you are feared for the daughter, do a stakeout get pictures take the girl to a counselor...get proof!

I think that dad should have a good enough case to atleast get temporary physical custody. Unfortunately CPS doesn't always help those in need. Try having the kid talk to cps.
