i was caught for dui and public intox. and now i have to wait for 2 months before i go to court. i have a previous record of just dui that happened about 20 some yrs. ago twice. i have an attorney. so what should i expect to happen? i am 57 yrs old and i'm on disability. any answers would help.

It's because you aren't the only inconsiderate boob out there who endangers the lives of others. There are plenty more where you came from.

Depends on the jurisdiction. I was nabbed in 1996 in the next county and the laws were slightly different.

I think the waiting period is mostly due to the backlog of those who have also been arrested for such an offense.

In 96, I paid about $2,500 in fines and lawyer costs, lost my license for 3 months (because it was my only offense) and had to go through an Accelerated Rehabilitation (ARD) program where I went to sessions with other DUI's twice per week and a class once a week.

ADDENDUM: That experience scared me straight for a few months, and although I returned to drinking and drugging I did those things after I got home so that I wouldn't get caught. Finally, in 2004, I entered a 12 step program similar to what was being taught in the ARD program. I have been totally clean since July 2004 largely due to the program and the principles I have learned.

90 to 120 days for a DUI trial is not usual at all. It depends on what the Court's schedule is and how many other cases are being tried and the severity of the charges.

It depends on the laws in the State where you now reside. As you have priors, even though they are 20 years ago, you will likely have to go to rehab (if you have good insurance or on Medicaid, better of to start now) or go to Court Ordered alcohol classes which usually run $20 or more per meeting (cash at each meeting) and be ordered up to 3 times a week and have to attend AA meetings 2-3 times per week (at no cost, but required to get a signature from the group leader to prove attendance) all while your license is suspended for 90-120 days.

Do whatever you need to do to check out all public transportation to get where you need to go, or taxis in your city if the city bus won't work; otherwise, you need to call in favors from family, friends and neighbors to be sure you go to every meeting that is required, or your probation will be revoked and you will go to jail for the entire amount that is sentance, which could be from 2-10 years, depending on the state that you reside in.

The reason you have to wait for such a long time, is because if you could see the Courts Log on Trials it is un-believable. Hundreds of people who are waiting for their hearings. Sorry for having to tell you this , and being your 57 years old and on disability, your time is running out and can not afford any charges like this. When do you learn ?? Are you a slow learner ?? The sad thing about all of this there are many hundreds of slow learners. You should be ashamed of yourself for being disabled and falling into this catagory. If your put in jail or treatment, your disability will STOP !

They just don't have enough time. They have to hear cases with priority first, i.e. in custody matters where the defendent has to have his/her appearance within a certain amount of time. Just be glad you're not waiting for a divorce court date. They get put pretty far down in the priority list and some people have to wait more than 6 months for a court date.

You broke the law. Enter a plea of guilty, and help move things along in our legal system.

You could easily have killed someone. With luck, you will get jail time, and you'll have a good bit more than 2 months to think about what you did.
