Generally, which ever property the tree is planted on, it's their responsibility. BUT, if the tree is overgrown, and the branches that fell were spread over on the other property and they did not maintain that part of the tree, then they might be partially at fault. The best way to find out (according to your local and state laws) is to either contact a lawyer OR call your local sheriff's department and ask them...they may be able to tell you (for free).

Whose property is the tree located on? If it is your property and the branches fall into your neighbor's yard, it is without question your responsibility to pay for and provide restitution for the damage. Trees that hover over the property line which end up falling or breaking due to neglect on the owner's part becomes the owner's responsibility. A tree limb if properly maintained should not fall onto a neighbor's property unless from an act of God which is not able to be forecasted. Either way it is still the tree owner's responsibility.

If they were your trees, it would be your responsibility. It gets tricky with overhanging branches, because - legally - a neighbor could trim branches to his property line....but the damage question still falls on the owner of the trees.

They key is that the tree overhangs your hous, meaning it's over you property....therefore the removal of the branches is your responsibility. You can trim the branches all the way to the property line. You can gripe all you want and as loudly as you want but the reality is that your neighbor cannot control tree growth and has absolutely no legal right to come on to your property to do tree maintenance --- nor does he have a legal obligation to maintain the portion of the tree that grew towards your house.

If the trees are on your property, then you are financially responsible for damages.
It's best to try to help your neighbors and hopefully you guys have a good relationship and they will work with you on how you want to take care of any damages if you don't want to file a claim with your homeowners insurance.

If they are "your" trees, then they are ultimately your responsibility. If the branches over-hung onto your neighbor's property, he would have been within his rights to trim them back so that they didn't encroach upon his land. The ultimate responsibility for any damages caused by trees that you know are yours would be borne by you.

You are. You're resposible for the trimming the trees that are on your property. Unfortunately, you are responsible for any damage caused by your trees. Keep 'em trimmed.

Your trees-your responsibility. Hire some guy to trim them or even cut them down. But either way, the damage is your fault.

If they are your trees and they damage your neighbor*s property, it is your responibility.
And he can sue you if you knew (or he told you) the trees were in danger of falling on his house or car or anything on his property.
