I am importer imported a consignment of $10000 and my friend imported same kind of consignment of $120000. A Addition Commissioner charge penalty of 45% on my consignment and only 12% on his consignment. I know he got money from him. What I have to do now?

Your Cargo Clearance Agent is a fool. Contact me I'll introduce experienced Cargo Clearance Agent who gets the things cleared with paying less penalty, how he does it its his way to do. As far making money by the Custom & Excise Employees is concerned they are the most corrupt government servants in the whole system, how can you think of getting your matter settled without bribing them, if you become another Mahatma Gandhi & want to get things done as you did in this case then you'll meet the same fate every time. If you want them to be punished under the Prevention of Corruption Act1988, then you'll have to file such complaint against the whole department of Custom & Excise not one officer. For the present case go in for appeal against the order & cite the example of other case where lesser custom duty was impossed, may be you get some relief.

File and application under RTI Act seeking all the documents and notings on both the files. Then you can make what is the difference there.

file an appeal in the office of Appelate Collector of Customs through a lawyer who deals in customs & excise cases.

There' no way you can get any Government work done in India without bribing. That' s our system and FATE. So enjoy the system and your FATE !!!!!!

I think they have'nt any formula/createria to check. Complain it to all NGO's/Court/Anti Curroption department/Media/CBI and others
