It takes any book a while because it is based on individual sale (not wholesale). Also I think it is because it is classified as a childrens book (which do not go on the list). Here is what Wiki says about the process for non-children's books:
The list is based on weekly sales reports obtained from a selected sample of independent and chain bookstores, as well as wholesalers, throughout the United States. The sales figures represent books that have actually been sold at retail, rather than wholesale figures,[3] in an attempt to better reflect what is actually purchased by individual buyers. Some books are flagged with a dagger (†) indicating that a significant number of bulk orders had been received by retail bookstores.

It's not on the main fiction list because the earlier books were saying on the list so long the Times decided to make children's best-sellers lists. Harry Potter is at the top of the children's series list (and it's been on the list for the last 150 weeks).

NY Times used to publish their children's list on Sunday, but for some reason, they stopped doing it. The list is on their website, and Harry Potter 7 is not on it this week. Harry Potter 1 is on as #1 under series books for 159 weeks. Pax- C

Why did it become a bestseller. People nowadays have nothing else with which to fill their heads. NY times is a bit more serious about which book the choose.

the book sold about 10 million copies so far (it might have been even more)so i think it deserves to be on the list, however since it's categorizes as a children's book, it will be on that list only.

I wondered that too! Probally because the harry Potter books where last weeks fad. It came and went. The people who wnted the HP book alerady got it. So sales are probally going down.
