Or will it fail a part of the smog test due to modification?

As long as it passes the emissions test there should not be any problem. But that is going to depend on the State you live in and the inspector.
A lot of states also have a provision for modified experimental cars which the emissions standards are not as strict. You might have to re-register it as a modified experimental car.
But that all depends on the state you live in.

It might fail. Put the stock intake back on for the smog. If you don't have it try an auto dismantler or junk yard.

I assume you live in cali. Well me to and unless your intake is ca approved it will most likely fail. It needs to say 50 state legal. They do make them .

You may have a problem, but in most cases no... But make sure if your vechile is still under warranty that its 50 state legal or it will void it...
