the empolyer has not made payroll in 3 weeks.can the employer withhold seperation check if not in bankruptcy?

the next regularly scheduled pay period. By the way, there is no such "RiGHT" to a separation check. You are only required to be paid for time worked.

If you quit you will get paid on the next pay period as long as you have pay coming to you. Otherwise if they had fired you it would be within 72 hours.
