I am a resident assistant at a local retirement home, and my bosses are being very impatient with the fact that I am pregnant. Occasionally, I'll call in sick to work because of nasty morning sickness. Also, I'll have to have my schedule adjusted for doctor's appointments and such. Now, the bosses are treating my like dirt, cutting my hours back drastically, and putting all of my other co-workers. I always work weekends now, I have the the worst shifts (night and graveyard), and even though I've talked nicely to my bosses about this, nothing is being done. They pretty much ignore my every request and continue to gripe and screw me on my hours and shifts.

What can I do about this!? Thank you!

Frankly, there is nothing you CAN do legally because while they MAY be discriminating against you, it is not ILLEGAL discrimination.

The company has the right to protect it's residents and alter your schedule to insure that your absence does not affect the care they give.

AND JUST SO YOU KNOW: I AM an attorney.

FOR memememe: FMLA does not apply under the provisions of the facts provided. First, FMLA must be applied for in advance. There is no facts presented that the poster has done so. Therefore, while FMLA MAY be an option, it is irrelevant to the current situation.

ALSO, FMLA is ONLY available to an employee with more than 12 months of employment. There are no indication that this poster has been employed for that length of time.

If she would like to come back and fill in the gaps my opinion might change. However, based SOLELY on the facts provided, my answer stands.

By your own admission you seem to have problems with the schedule they had you on. Working the nights and weekends will allow you to not worry about making your doctors appointments and such. If you are just getting to sleep that morning sickness can be better controlled while laying down.

I would look into FMLA. I used it when I was pregnant just so that I was not looked down upon for having so many unexpected absences during my periods of bad morning sickness. A lot of places of employment will offer this ~ FMLA is unpaid time off of work for a continual medical condition.

I dont know about unions, but you could quit your job and find another or write about this in a newspaper article. A pregnant lady shouldn't be treated like dirt, and if you publish you experiences, you would surely push for reform.

Stop whining and get to work. you already admitted that you miss work for appointments and with morning sickness. Putting you on nights and weekends avoids that. you are not being discriminated against, you are just pissed you don't get SPECIAL treatment. Get over yourself.

If you have a human resources department, start with them. If they do not or are not willing to help you, then check with EEOC http://www.eeoc.gov/

your union, sue them, go to labor department.
