i cant have them
so i told him to arrest me

Why were the cops involved in the first place?
Go to store.
Buy markers.
Go home.
End of story.

no no paint markers are not illegal.
but it depends on what you were doing with them.
if you were vandalizing property that was not yours with them you could be in trouble.
