They can file harassment charges but the burden of proof lies on the prosecuting attorney to prove it was you and not someone else.

What do you mean? Do you mean can someone file for you? or do you mean can someone file charges against you even if your not the one doing the harrassing?

No, someone does not need to be me to file a harrassment suit.

in my organization you can file a complaint (but not an eeo complaint) if you are a third party (ie witnessed harassing behavior even if you weren't the target) and the agency will investigate and possibly take action. They are doing this to try to keep the workplace free of behavior that could actually be illegal - nip it in the bud before it gets larger- that's why they want to know from 3rd parties.
