I live in Georgia, does anyone know how I would go back to using my maiden name. My home of record is South Carolina. My divorce was finialized in Georgia. Can anyone help me out with this. I really want to get it done this week.

Unless you requested to have your name changed back to your maiden name during the divorce process you will have to file for a name change via name change order which you can file for at the local county courthouse. (PS You don't need to involve an attorney in the process, just make sure to visit the courthouse and get the correct paper and follow the process.)

You can't just change your name by contacting social security you'll need the correct documents to update everything.

The people at the courthouse will have some paperwork for you to fill out and you should bring at least two people with to the hearing to verify your identity is correct.

"In all divorce actions, a party may pray in his pleadings for the restoration of a maiden or prior name. If a divorce is granted, the judgment or decree shall specify and restore to the party the name so prayed for in the pleadings."

In each state, you have the option at the time the divorce is finalized to return to your maiden name. I did not do so and had to have my attorney file a single document later to regain my name.

If you can't get it quickly from your attorney, call the court where your decree was issued and ask how you can get a generic form to file yourself to regain your maiden name. If you live in GA, and that's where your divorce was finalized, I don't think it matters what your "home of record is", you just do it in GA where you live.

I do not know how quickly you can get it done. You might be able to within this week, but you need to discuss that with the court clerk.

You need to simply prove, by your marriage certificate, what your maiden name was and fill out a form through the court in Georgia.

I think it's a simple matter of requesting another social security card in the original name ( the number remains the same but the name changes, or in your case, reverts back). Double check this advice with a leagl authority in your current state, but I think I'm right.
