If its your tree then the berries are too, if tree on your property. if tree is partially in the neighbors yard - i would just pick up the berries- because the neighbor could make you trim the tree .

Yes, you own or hold papers that state that you possess a certain point of land. If a tree on your property crosses the imaginary line that is not your property , well it is your tree.
The neighbor can trim or cut any offending growth that crosses their property.
So no, you are not responsible for the mess. Or the mass.
When the wind blows the leaves,berries, seeds from a tree then the wind is the responsible agent.
Sue the winds.

i believe the neighbor has the right to whack off branches as soon as they cross the property line, so the branches and the berries in his side might be his. Local laws on this subject might vary, so check with your town.

no it is an act of nature, as stated the neighbor has the right to cut the branches back of his/her property
