My friend live in NC,he has a job as Ass. Manager for a restaurant /fast food. He got a second job (evening shift) at Target. He can still do his job at the restaurant full day and afternoon shift. Well, they cut his pay ($1 less),cut his hours and he is not longer Ass. Manager but regular worker. Can they do this,is it legal? To me it's de motivation to find a second job. He really need the second job,very bad.

I'm a Human Resources professional in North Carolina. North Carolina is an at-will, right-to-work state. Documentation is not needed to make this kind of move. It is legal.

Hi A. In Ireland we have strict Labor Laws, so my answer to you is based on Irish Law.
They have no legal right to do what they did.
It sounds like Constructive Dismissal.
This is where an employer makes it so difficult for you to do your job, that your left with no alternative other then to quit.
In Ireland if this were to happen , the employee has recourse through the Labor Tribunal. It costs nothing and three judges decided if there is a case to answer and if compensation should be awarded.
Your friend should go and get legal advice from Free Legal Aid or a local Trade Union Official.
What they have done is criminal and I.m sure if he went public he will soon find that they have done the same to others.
He should join a Union , that way his rights will be protected.

They cannot arbitarily cut the man's pay.
He had to be on disclipene or demotion. That must be documented in writing and they had to sign this.
So, because he took a second job, cannot have any impact on the first job, unless he could not make his shift or complete a shift.
You have not indicated this in any way.
he is entitled to the back pay.
he should go to the labor board first and lawyer second.
he may own this restaurant one day.

It is legal and permissible for a company to change an employee's title and/or pay at any time, for any reason.

Whether or not the employee has a second job is immaterial, although many companies do have policies which prohibit or limit second jobs for their employees.

Yes of course they can do it, its a demotion..this happens all the time at a workplace. Hes lucky to still have a job as far as im concered

Of course it's legal. Companies can do whatever they wish with pay rates and job titles.

It's called being demoted, and yes, a company can legally demote you without a reason.
