Taiwan doesn't have any legal options separate from the Chinese mainland. UN general assembly resolution 2758 declared the PRC legitimate representative of China. Article 2(7) of the UN charter explicitly mandates that "Nothing contained in the present charter shall authorize the United Nations to intervene in matters which are essentially within the domestic jurisdiction of any state". Since state sovereignty is perhaps the most fundamental tenet of international law, and Taiwan is historically Chinese, the so-called ROC has no legal basis for secession.

In a protracted conflict China's economy and population guarantee victory. However, Taiwan does possess sufficient defensive capabilities to resist a Chinese assault due to the People's Liberation Army's highly limited capacity for amphibious troop deployments. While attempting to repel the Chinese air force, Taiwan would seek international support, most likely from the United States. But don't be fooled, the defense pact between Taiwan and the U.S. is long defunct, as one Chinese general put it "the United States would never trade Taipei for Los Angeles."

Taiwan is not a part of PRC territory, and there are no international legal documents which can prove otherwise.

Taiwan is occupied territory of the United States, so of course the USA has "disposition rights" over the territory. The Shanghai Communique is an Executive Agreement between the USA and PRC. Certain clauses in the Shanghai Communique outline a "vision" of a future intended disposition of Taiwan territory.

However, there has been no final disposition of Taiwan territory to date.

If the Taiwanese people do not want to follow along with the USA-PRC planning on this issue, as specified in the Shanghai Communique, then they should be demanding their rights under the US Constitution.

As an overseas territory under the jurisdiction of the United States Military Government (USMG), the Taiwanese are entitled to certain fundamental rights under the US Constitution. No doubt it will be necessary to file a lawsuit in US federal court to obtain these rights however .....

Taiwan will never merge with the PRC, that is for sure.

Prosper? Probably not. They can always move to Crete, which would be too far for China to mess with and if they merge with the Greeks and Turks living on the island to form the nation of Crete, it would help end the hositities between Turkey and Greece over the ownership of the island.

China represents slavery and bondage. Taiwan stands for freedom. Freedom and slavery cannot merge. I cannot speak for the people of Taiwan, but I myself would rather die free than to kiss Chinese butt.
