Midnight is still the last second of the day of. It would have to be born one millisecond after.

If I was the mom, I would be pushing like hell. Think of all that money you can claim back!

EDIT:

Maybe the doc would give the mom a choice? That would be cool. Sometimes there are prizes for the first born of the year at a hospital.

Birth doesn't happen quite so instantaneously as you suggest. Do you count from the appearance of the baby's head or from the delivery of the entire body? I can see an argument either way. The midwife or doctor delivering would deliver first and then check the time. It is unlikely that any clock would be striking in the delivery room, so it would be a matter for their discretion. They would probably find the thought of delivering the first baby of the year irresistible, so I imagine that their discretion would be exercised in that direction.

If they were born at midnight they probably would be listed as 0001 of the next year! People love to have the first baby of the New Year.

It primarily depends on the person delivering, but my guess is that it would be the next year!

My mother was born then. They forgot to record the time so were never sure if it was just a minute before or a minute after. She always celebrated New Year as her birthday :)

altho not on a new year, i was born at midnight exactly and given the following day as my date of birth.

It should depend on how the birth certificate is signed...Is it dated Dec 31, or Jan 1??.....hopefully you got the doc to give you the old year for the tax break

they are a new years day baby my son was born like that and his date of birth is 01/01 1988.
