My landlord is evicting us even though we worked off a years rent plus an extra six grand that we weren't even going to charge him for (we are contractors). We heard that this is not the first time he has done this to contractors and we would like to sue for the money that is owed to us. He is suing us for two grand in rent plus legal fees and he owes us close to thirteen thousand. I would like to countersue but seems pointless if it will just even itself out.

It is a very small town so everyone knows everyone. Actually the landlord is also a lawyer and all the judges know him, they also all hate him. He has sued people and been sued so many times that when you go down to the court to file and mention his name they literally roll their eyes and say "oh him". That is why it took 3 months between the unofficial letter he sent us and the time he filed.

$5,000. If you have a $13, 000 claim, you will have to file a formal law suit with an attorney.

Get yourself a good lawyer. More likely judge knows your landlord and landlord knows the judge. If you will come to court by yourself and without being represented by an attorney 99% you are going to loose your case. You may appeal same within 30 days to higher court, but it will be more complicated as you might be required to open special escrow bank account and deposit $2,000 there. Get yourself a lawyer.
