If you get married to someone else, that does NOT sever ties with the bio. dad....he is still responsible for his child up until their are 18.... he will still have to pay child support..unless your new husband adopts your child. If that happens then the child's bio dad is no longer responsible for his child. The responsibility falls then on her legal father "step-dad" (because if your new husband adopts her / him it terminates the bio's dad's right completely. and that includes financial responsibility)

Normally you would have to wait 6 months after you marry for your new husband to adopt your child.

What you need to do is apply for child support and get the process going.
I have delt with many cases regarding this. What he pays depends on if he is working or not and how much money he is taking home (if he is working)

He May not want anything to do with the child, but it is still his responsibilty to financially pay for the baby. You would also have to do a paternity test before child support to determine that he is the father.

In most states you are entitled to get child support. Go as soon as Monday to your local Department of Social Services and give them the low down on who the father is. If your future husband adopts this child, then the biological father gives up all his rights, and he also is relieved of paying child support. Make sure this guy pays the support and not your fellow taxpayers.

I believe that your child is entitled to receive support from the biological father even when you get married to someone else. I'm not sure about the adoption part though. Guys have that nasty habit of running away from their responsibilities and would risk jail time instead of paying. I have friends who only get $20-$30 from their dead beats and settle for that. Take his baby-making *** to court and get what you can.

whenever you are not living with the biological father you can apply for childsupport. If you choose to get married you will still get the childsupport as that is for the care of the child (not you or the new guy). As for your new husband adopting the child you will have to have the biological father sign away his rights first or have a court take away his rights in order for the adoption to take place.

If the child is adopted, then you give up your right to child support, not if you just get married though. The one thing to consider though, is that by collecting child support from the biological father, you are giving him an open invitation to enter his child's life.

if you have found a man that wants to love and adopt your child, welcome it,it is far more priceless than child support, wich can be a nightmare if the other parent is already an unwilling participant.if you dont have someone else adopt your child then yes you can go after child support,it isnt much though,I get $25.00 a week from a union carpenter who makes over $20.00 an hour..yipee,and hes such a jerk to deal with I wish he would take his 25 bucks and go somewhere!!

If your new husband adopts the baby, then the bio father would not have to pay support, and he would be giving up all his rights to the child - technically it wouldn't be his child anymore. Laws could be different where you are though.

Unless the new man in your life adopts the baby he remains the financial responsibility of his biological father and THE BABY is entitles to child support.

As per law in India, even an illegitimate child is entitled to the biological father's property and earnings equally with his other legal children.

even if you are married you can still get child support from the bio dad.

if there is an adoption that means that the bio dad is signing away all rights and you would not be entitled to child support.
