I am legally seperated and have already filed for divorce. My ex recently lost his job, and the child support order goes before the judge this week. Will they order him to pay what he was making at his last job? He was there for about 10 years. I imagine that I will continue to receive nothing until he finds employment. Is that correct?

you won't receive anything, but he will accrue back child support until then. child support will be calculated on what he is capable of making on a monthly basis. he will be required to regain employment at another location. request a time line for him to find a new job, such as 3-6 months. continue the hearing for 6 months and see what his status is. if he is employed again he will be reassessed on support. if not, the judge won't take to him very kindly.
one other thing, if he lost his job through no fault of his own, you can still collect on his unemployment and if he got a severence check.

Sounds to me like the mother filed papers for support, they can "come at you" like that because she filed and every legal guardian of a child has the right to try to pusue child support. Unfortunately for you, it does not matter in the eyes of the legal system, how much you support your child. But if I were you, I would contact your local child support enforcement center and make sure that however much they will be deducting from your pay is the right amount. They can legally only take out a certain percent of your pay, and if you have not gone to court personally and proved your wages, they could be taking more or less than what they are legally allowed. You should receive a portion of his unemployment check for child support--that should be automatically taken out.

Well about the child support you probably wont get anything until he starts working, because they go by your income, and if he doesn't have one, he cant pay you! :(

He needs to find a job really soon, talk to your lawyer about this, if he's getting unemployment I'd say you should be getting some of this money.

He will be ordered to pay according to his income. I suggest you not look at this as income for YOU since it isn't...get off your butt and get a job.
