this is a really old small house when we moved in the landlord said it wasnt a good place for kids i got preggers a short while later and although our lease said to let them know about children i never did now they have sent us a form asking if their are any children i think they drove by and saw kiddie stuff im scared to reply in fear of getting kicked out-we have 21/2 years left on our lease

Is it an older place? A landlord can terminate a lease when you have a baby if the place you live possibly has lead paint. They can't rent to a household with children if the house is not lead free. It's for your child's safety.

the only reason i could think that he could get away with it is if it A. is if it says no children in the lease or B. if you are living in a house/apartment that is only designed for 1 person (or 2 if you have a spouse whatever)........i know my house says right on the lease that we are allowed to have a maximum of 4 people living here, if we were to have another baby we can transfer our lease to a bigger house through the same landlord or terminate it with a 60 day notice. if you live in a 1 br or a studio theres a good chance this is the case.

I doubt it - unless it was expressly outlined in the lease that the property would not allow kids. This happens alot in 'senior' communities -when the grandparents have to take care of the grandkids because the parents cant care for them themselves. There was a big story here last winter because a grandma had to sell her HOUSE in a senior development because she had to care for the grandkids when both parents got sent to Iraq.

The only way it would legal is if you are already at the maximum occupancy for the residence. For example 2 people and a baby under 6 months are allowed in a one bedroom, 4 and a baby under 6 months in a 2 bedroom. You should be allowed to stay at the residence until the baby is 6 months and then you would be required to move if at occupancy limit.

I doubt it, but read your lease. Any reasons for termination will be in it. There is usually a warning period also, like you have 60 days to move. They cant just kick someone out the next day.

There may be a clause in the lease that says no children are allowed, but he's treading on childbirth and Family Leave Act laws.

Get a copy of the lease to a lawyer pronto.

depends on the lease. if the lease says that you can only have 2 persons in your apt, and you add a 3rd (baby), the it is possible. i have had a tenant who had 4 kids, was pregnant, and the lease said max. 5 people per space (rv park). we could have evicted, but we decided not to because the kids were well-behaved. not sure if rv parks run differently than apts though.

NO!!!! Your being a parent and where you had the baby has no bearing on your lease. The only reason he could terminate the lease is if you are in a exclusive place that is for "singles only" and only then if you have the child with you.

If your renting a 1 bedroom...many state have local laws that prohibit more that two people living in a 1 bedroom apartment.
