Ive noticed more and more recalls concerning products made in China. I have a 10 month old child and noticed all her toys that she puts in her mouth are made in China. If there is a recall of lead paint being in the toys and she gets sick who is liable and can I sue.

I would say yes. I am in the same position and just as yesterday I herd something very alarming. That the vinyl bibs sold at Toys R US have 30% more lead then a can of paint. Do you know how many bibs I've owned from there? Her next dr's appt she is being tested for lead posining and if I find any traces I'll be sueing the company a Toy's R US... it seems nothing is safe any more.

The recalled Toys were some Sesame Street toys and Dora the Explorer. Mattel's recall was the car from the movie Cars called the Sarge. There also was a plastic baby bib sold at Toy R Us or Babies R US that had lead paint.

If you are really concerned about it then just get rid of the toys or buy a lead test kit and test her toys yourself.

Unlikely. The amount of lead in those toys isn't enough to cause problems for most children unless the paint was chipped off of 5 or 6 of them. Very few, if any, American children will have any level of lead in their blood from the toys. In a lawsuit involving lead, you have to prove HARM and just having a level of lead in the blood does not prove that.

The toys are from Mattel and Fisher Price. If you go on their website they have a list of the toys that are recalled. Take them back to the store or throw them away immediately. You really don't want your child getting sick to have a lawsuit.

Seems like it's a matter of international laws to me since in China there may well not be a law against it. You could sue Mattel. They supplied you the product, in the U.S., under the U.S. laws. They contracted the work. It was their responsibility to make sure their product was safe. Thereby they are liable, not China.

My advise would be, keep any Made In China toys away from her!!! It's not worth the risk right now. Just today I saw that they are also recalling bibs, hundreds of thousand of them made in China have lead in them too!
Besides the head guy at the plant where the lead painted toys were coming from just killed himself - so they are sure to blame him so no one else can get sued!!!

I have the same problem & someone told me to take all the toys that were made in China away. GOOD LUCK. Look on the back of every toy & what does it say...."Made in China" or "Some parts made in China" even wooden puzzles that I thought were safe from "Mellissa & Doug" and other companys are all made in China!!!!!!!!!!!!!!!!! If someone out there knows of a toy company with toys not made in China or parts made in China.....please I'd love to know...and I'm not trying to be smart!!!!

you sure can.
toys from MATTEL Inc. are the ones leading in the recalls. Heaven fobid something happend to you're child you can sue the store from which you purchased the product from and Mattel Inc.

Sue the distributor of the toy or the company who subcontracted the manufacturing to china factories. Implead the chinese manufacturer, if you may.
