Since just about every county has their own health department and state laws very by state, without knowing where you live there is no way of knowing.

Here where I live there are no limitations on wait-staff wearing earrings.

Check with the regulating agency, either county or state. Most have a web site. The basic premise is that anything that could grow, harbor or transmit germs or disease is prohibited or must be mitigated.
