YES, it is a moving violation, and the officer should be reprimanded for giving "legal-advice"!!
You DO realize that sending in the reciept with the ticket will PROVE to the Judge that you did NOT have the headset at the time of the violation ??
Since you pleaded "not guilty" you may now have to go to court, and if you attempt to tell the court you had the headset at the time of the violation you would probably also be charged with PERJURY !!
I am GLAD that many states have finally put laws into action that ban the use of handsets while operating a motor vehicle... I was struck by an SUV driving, Cell-phone-babbling woman 3 years ago in BROAD daylight in a crosswalk as she made an illegal right hand turn. She lost her license, and did 90 days for felony hit and run.
I want to see the INSURANCE companies give LOWER rates to drivers who will accept a "Black Box" in their car that measures acceleration, braking, turns without signals, cell-phone useage, etc. If you drive LEGALLY at all times, your rates should DROP, if you violate ANY laws, the insurance company would RAISE your rates.
You are GUILTY... pay your $100, suck up the insurance hike, and LEARN YOUR LESSON... be happy you didn't hit something or someone.

Some cities and states have adopted laws that make it illegal to talk on your cell phone while driving. So, the ticket is legit, you can plea not guilty if you would like.
As far as your insurance going up, I can't tell you. Some of that depends on how your insurance company looks at things. Insurance companies can raise your rates with any given excuse. I was involved in an accident, not my fault, I was struck from behind. My rates went up, although I did not get cited, because my insurance company said I am now "prone to accidents" True story.

To be honest with you, I feel everyone (not just those under 18) should be ticketed for using cell phones while driving. I have almost been hit by people using them while driving. One woman never even looked before she pulled out, She was too busy yakking on the phone. I feel this is a hazard. And I don't believe headsets are the cure, It is not just the action of holding the phone that is the problem, It is being distracted that is the issue. And yes, If you are sited then it will more than likely go to your insurance.

A ticket will only go on your driving record if you are convicted or plead guilty. Judges may dismiss the charge with a warning in some cases, but that's no guarantee.
Please use your headset to avoid another ticket and possibly a fatal mistake.

Some Jacka$$ was on his phone the other day- ran right through the red light and just about T-boned me. You deserve to get a ticket- I bought a head set when the law first came out - why should I have to obey the law and you don't have too? Pay your fine and pay attention to the road.

You know, I have to say I hope it does go on your record. When you're driving, you should must be driving, and that's all. What is so important that you can't wait till you're not driving to talk about it? Talking on the phone, even if it's hands-free, is still a major distraction. And yes, it is a moving violation.

You should have been beat around the head with your cell-phone only a complete idiot would drive and talk into a cell-phone!!
Hopefully the cop gets a reprimand for telling you how to cop out of a 100 dollar fine.
