The Elder Wand passes to whomever defeats or takes the wand away from it's previous owner. As stated, Draco disarmed Dumbledore at the end of the Half Blood Prince, just before Snape killed Dumbledore. Once Draco disarmed Dumbledore the Elder Wand recognized Draco as defeating his current owner and transferred it's allegiance. As Olivander stated, you do not have to kill to become the new owner of the wand. The fact that the wand was so powerful made it an object of desire which led to many killings to possess it over the years. Dumbledore did not kill Grindelwald to get it and Grindelwald in fact stole the wand from Gregorovich to possess it. Harry gained possession of it simply by physically disarming Draco of the wand he was using. At that point, even though the Elder Wand was not there, Harry became it's master.

The true owner of the elder wand was Draco because the night Dumbledore died,Draco disarmed Dumbledore which makes him rightfully the new owner.J.K Rowling explained that youdon't have to kill to be the owner of the wand..you just need to disarm the person..that was why the wand didn't work for Voldemort because he just took the wand from Dumbeldore's grave not knowing the true owner was Draco. But since he thought Snape's was the owner he killed him but still the wands didn't work for him. However Harry disarms draco thus being the true owner of the elder wand.

Voldemort was shocked because he didn't know this information whom Harry knew..

P.S You are not a geek though..that part was quite hard to understand even I read it quite a few times to understand it.. * :) *

Harry says Malfoy was the true master of the wand, not it's owner. Malfoy never owned the, to do so he would have had to pick it up and keep it after defeating Dumbledore.

And you do not have to kill to gain the wand's allegiance and become it's master, though Voldemort believes so. All that has to happen is that you defeat the previous master of the Elder Wand. Gregorovitch was the wand's master before being defeated by Grendelwald who stole it from him. Dumbledore defeated Grendelwald in 1945 and he, Grendelwald, then ended up spending the rest of his life in the very prison he built to imprison his rivals. Both Gregorovitch and Grendelwald were killed by Voldemort in his search for the Elder wand.

Malfoy disarmed Dumbledore before he had a chance to duel him on the night Dumbledore died. He was not about to let Malfoy damage his soul by killing him, so he would have dueled him to prevent it. But the duel ended in defeat for Dumbledore before it could begin. Then Snape came along and, as he and Dumbledore had planned, killed Dumbledore. The wand would never would have given it's allegiance to Snape even if he hadn't been carrying out Dumbledore's request because Dumbledore was disarmed and unable to fight back. He was completely helpless before Snape even came onto the scene.

Harry then became the master of the Elder wand by defeating Malfoy and taking his wand from him. Because a wand's allegiance can change if it's current master is defeated, Harry not only took possession of Malfoy's wand when he defeated it but also became it's new master. He put the wand away before he let Voldemort kill him in the forest so he would not be tempted to fight. So the Elder wand was less likely to sense the fact that Harry had defeated it's last master. But in the final showdown between Harry and Voldemort, Harry did fight. And the Elder wand was much more likely to sense the fact that the wand that had been used to defeat Dumbledore, the wand that had caused it to take Draco Malfoy as it's new master, had sworn allegiance to a new master. It could sense that Harry had defeated it's, the Elder wand's, last master and so it swore it's allegiance to him.

Voldemort was surprised because he thought he knew everything about the wand, thought he knew more than Harry did. But Harry's revelations were totally unexpected.

You dont have to kill to own the wand just beat in a duel, etc. And as Draco disarmed Dumbledore on top of the tower, that made him the owner. But as Harry disarmed Draco (even though he had never touched the Elder Wand) Harry became the owner, BUT as Harry was the last remaining Peverell, he was the official owner anyway and the Elder Wand would never have killed him.

some of these answers are really wrong. Draco was the true master of the wand because he disarmed dumbledore at the end of the 6th book. The wand recognized that it was taken away from it's old owner and pledged it's allgience to the person (draco) who disarmed his master. Draco then became the new master of the wand although he didn't know it or even touch it. The wand just recognized that draco's wand (not the elder wand) disarmed it (the elder wand) from it's old owner (dumbledore) so yeah.
hope this helps!
i was really confused about this too but now i get it

Wow! A useful answer....

I had the same question because Deathly Hallows did a very poor job of explaining the question of the elder wand ownership. I had completely forgotten that Malfoy cast the wand disarming spell the instant he saw Dumbledore. That disarming was the true defeat of Dumbledore.

I was dwelling on Snape murdering Dumbledore and the notion that the Elder wand normally transfers by a bloody defeat. That's why I forgot/discounted the Malfoy disarming trick.

Thank you folks!

If you read carefully you would have read that when Draco Malfoy disarmed Dumbledore on the Astronomy Tower, Draco unknowingly won the Elder Wand's allegiance.

Dumbledore was the master of the Elder wand, by virtue of defeating & capturing Grindelwald . At the end of the Hp-6 book Draco Malfoy , disarms Dumbledore who was the master of the wand [The Elder Wand ], with the 'Expelliarmos' spell. So Draco becomes the master of the Elder Wand from that moment. It is not necessary to kill to become the master of the Elder Wand, It is sufficient to beat the previous master . When Dumbledore was the master of the wand Grindelwald was alive & in Nuremberg in solitary confinement.
Voldemart very badly wanted to kill Harry. In his previous encounters with Harry he was not able to kill Harry with his wand.So he wanted to own & become master of the Elder wand and use it to kill Harry. He was under the impression that since Snape killed Dumbledore, he was the master of the Elder Wand & by killing Snape, he can become master of the wand.So he killed Snape . But as Harry explains , when Snape killed Dumbledore, he was not the master of Elder Wand. At that time Draco was the true master. When Harry has beat Draco , When he removed his wand from Draco When escaping from Draco Manor, Harry becomes the true master of the Elder wand, even though they were not Physically having the Elder wand with them.

SPOILERS BELOW:

Draco didn't kill to get the wand but he forcibly removed it from Dumbledore's possession. That made Draco the true owner. Snape killed Dumbledore but since he did so on Dumbledors's own instructions so the wand did not pass to Snape or ultimately to Voldemort. That's why the wand did not work for Voldemort. He did not understand this and that's why he was surprised.

At the End of Half Blood Price, it is Malfoy who disarms Dumbledore (meaning he overpowers him). Originally, everyone thought it was Snape who conquered Dumbledore but we realize that its not true in Deathly Hallows and that there was an agreement betwn dumbledore and Snape. Ollivander explains that wandlore is very complex but you do NOT need to kill in order to become the true master of the wand (as in the case of Harry using Malfoys)
