I have a son with ADD. His visits out of state with my ex-husband ruin his progress at school. Why should I let my son be pulled out of school for an extended weekend on Labor Day just one week after school goes back for the fall? This ex-husband has drug and alcohol problems, untreated bipolar, untreated abuse issues in his past.....

My son has never had to interrupt his school year before since I am primary residential parent. Due to my desire to marry again, I didn't fight hard enough to have full custody (the state we lived in then had joint justody by default) and now regret it....

Labor Day is not a specified visit date per the divorce decree anyway....

BTW, ADD is usually what kids with bipolar are diagnosed with because of their age. Sorry but ADD has nothing to do with bad parenting......Spanking makes bipolar and autistic kids worse, explorer idiot. Just move if you don't like kids!

I would contact an attorney to see what your rights are and to have the custody agreement modified. You can also refuse to allow your son to go with your ex if you feel that it's detrimental to your child. If he calls the police you can inform them that you are in the process of changing the custody agreement. Good luck.

I would go to court and present the facts to the judge. You of course will need proof of his drug and alcohol problems to be able to bring it up in court. I just don't think the courts will be to happy about your son's progress at school getting messed up due to the interuption. The judge could say that he can go visit him during the summer or something though.

Go to court and request full custody based on the ex's current lifestyle.

if you get documentation from your son's doctor and teachers, you can go before the judge. he'll probably make it so his visitation with his dad does not interfere with his schooling. i can't understand why the court would have allowed this in the first place.

Request that your ex gets summers so his school yr won't be interrupted.
