A very small percentage. 95-98% of cases resolve prior to going to trial. Of the few percent remaining, only a fraction need anything more than the witnesses involved.

Actually every case that has evidence that is submitted for examination and evaluation uses experts to analayze that particular piece of evidence. These experts can be called upon by either the prosecution or defense to testify if the case goes to trial. Star is correct in her evaluation of the number of cases that actually go to trial and she is again correct in the number of times expert witnesses are actually called upon to testify in the trial. At least this has been my experience working 35 years in a prosecutor's office handling major felony cases.

Nowhere near as often in criminal cases as in civil. Civil cases use them all the time, and a LOT of them.
