After being made redundant some time ago, i fell behind with my car payments, and unfortunatly have had my car repossesed. I was very suprised as i recieved no warning and thought we had reached an agreement on my payments. The probelm is that the company turned up at my house at 2am while is was out. Spoke to my brother and took the car without giving me any warning or opportunity to empty my personal belongings from the car. I have since been told that as i still have the keys, i must travel many miles to the place that is holding the car for auction, and collect the things myself. But this is impossible as i have no transport and the cost of travel is more than i can afford at the moment. I have things in the car that i need urgently, and also things like my passport and private bank documents. What should i do???

Report the car as stolen to the police.
Report your private belongings as stolen also.
Ask your brother for a ride.

I don't know how how many payments have been made and would suggest you look at the fine print. There is almost certainly a clause in it saying (Hire Purchase) that if a certain number of payments are made the Company needs a Court Order to re posses. You have an opportunity to collect your belongings, I don't know whether this would work but suggest that they bring your belongings back and you will give them the keys

this is a very grey area did your brother sign anything if so then id get there if not then i would speak to your local advice center straight away because unless they got your keys they shouldnt have been able to take it as they shouldnt have a spare if they took it on the back of a lorry i wouldnt be surprised if they have added that to your bill best thing to do is phone them be polite and try to sort out a payment plan they have to give you that opportunity.

Write to them and ask that they send your belongings by post and tell them that you will return the keys and the vehicle documents when you receive them. Report your passport etc stolen and name the company that took them. Tell police that they have refused to send them back.

Not theft, inconvenient yes. They are giving you an opportunity to retrieve your property. See if you can work something out with your brother to pick up the stuff.

It is not theft, because it is not your car. Your property was placed in THEIR car, therefore they stole nothing. You should take a cab or start walking to get your stuff. You definitely dont want to leave it in there. Worse case, talk to a neighbor and beg to have them take you.
