I live in Ireland 25 and the gardai have been in contact with my GP and I suspect that am mentally incapcitated.

Under what conditions can they declare me to be mentally a child.

I am not a child and I just have been particularly stupid.

You can be declared to have the mental capacity of a child (mentally incapacitated). If you are of sound mind with average or above intelligence - you cannot be declared a child medically for insurance or benefit purposes.

It is a difficult area, as if one has an adult body but a child's mind it is possible to be prosecuted in an adult court and I have seen a man with a mental age of 4 standing in the dock and looking terrified, having hit his care worker during a tantrum. Clearly such a person lacks the mental capacity to answer charges and the matter is dealt with out of court. Normally when it is necessary to determine the age of a child whose date of birth is unknown it is a matter of measuring bones and the decision of the medical practitioner will be accepted by the court.

Do you mean physically or mentally? IE you might be considered to have the mental age of a child even though you are a middle-aged man.

This not based on fact but logically a child would be - for "medical purposes" considered a child until the onset of puberty.

if you go into hospital you go into a childrens ward up untill 14 years of age after that you would go into an adult ward is this what you mean?
