against them in court, is this true?
and if so does it only apply if you actually answer the phone?

Keep on dreaming pal!
If you owe them money they will keep onto you morning, noon and night until you cough up.
The only court case likely here is when they take you to court to get their money out of you.

Sure, it's the law, but hard to enforce.

Wisconsin also has a law that business can't use "private name/private party" for the caller ID tag, but they do it all the time. Or they block their identity from their outgoing portal so it's hard to figure out exactly who they are or where they're calling from. When you try to call them on it they just hang up.

We've been getting harassed for 2 years by creditors calling about the old roommate and no matter how many times we say that the person is no longer at our address/phone they keep on calling.

It depends on who is asking you for payment, and what the debt is for. The Office of Fair Trading has guidelines about what can and cannot be done regarding money that is owed. If you do owe this money, then and can't afford to repay in one go, explain this to them. If your offer is reasonable, then they should accept it. Make them an offer that you can afford; the CAB or other agency will help. If it is an agency collecting the debt, and you refuse to talk to them; then they can 'rack' the action by things such as Door Step calling or taking you to Court.

It sounds to mean as though you do owe the money; you need to repay it, unless you have a legitimate reason not to pay.

1. If you do not answer the phone, they can phone you as many times as they want.

2. If they contact you and you say you will make a payment in week. They cant phone you up on that day asking for money, they have to wait around 2 days after (taking into account bank delays) if you havent paid.

They also have legal rights to phone you at 7:00 am in the morning or 9:00pm at night, as it is deemed more likely to be able to contact you at that time.

They can phone you on sundays.

The people you owe money have the right to call and ask if and when you are going to pay them. If your finances are such that you can not make payments call them tell them. They will be happy to make some sort of deal. A few dollars to them is better than nothing.

NO IT IS NOT TRUE end of story you cannot do anything in law re this problem as long as their is no threats etc apart from the threat of court action etc you learn to live with it after a time

If you tell them to stop calling, they MUST stop. They can continue to pursue collection actions and contact you via mail however.

it is harassement they can only call so many times aday and up until certain hours and never on sundays
