i already have a lawyer, and he thinks that we can do it without being married yet. we live in florida. we're willing to get married in a court just to do this but it would be great if we could just do it in may, since i already have deposits on the venue and photographer. thanks

my fiance and i have been together since my son was 9 months old and thats his daddy. his biological father has nothing to do with him and hasn't seen him in over a year and is willing to terminate his rights.

ok to clear things up. i am having my ceremony in may no matter what, for the families and we just want to have a normal ceremony. i was just wondering if my fiance could go ahead and adopt my son now since my ex is willing to sign over his rights now, without us being married yet. thats what my lawyer is going to push for, we'll get married now if we absolutely have to for legal purposes, but i would prefer to just have the ceremont in may, cuz it'll be different if we're already technically married, kind of takes the magic out of the whole wedding thing. my lawyer says this is a unique situation, i just wanted to know since all parties are in agreement if a judge would approve it.

If your lawyer thinks you can do it, then you don't need to ask us. Just go do it.

I know that all states have different laws but here in AR if the father goes for ones year with no contact and does not pay child support he loses all his rights as father. It will help your chances if you are married though. Courts here look down on ummarried couples and adoption. And if your child knows your fiance as dad.. it will always be that way. My youngest daughter didnt know her real father until she was six years old and she still calls my husband daddy. Her biological dad is called by his name. Good Luck....

I have a really cool idea...why not arrange it so that the wedding and adoption take place together? You would truly become a united family in one ceremony. Then you can have a reception to celebrate both wonderful events sharing the photographer ect.

Yes, I know for sure he can not. Your lawyer may be thinking a common law marriage situation. And I know he will need to have the biological father's permission. Unless, you are going to declare you do not know who the father is.

Here in myrtle beach, sc if you have no contact with your kids in 6 months its considered "abandonment" and you have no rights. If your ex will sign over rights than more power to you, I wish mine would have done that but he is stubborn.

why not go to court and let him adopt the baby and see if the judge can get married there too.
