I have an order of protection on my ex-husband's new wife due to threats on my life and harassing me and my young children. She is posting threats on my life if I try to collect the back child support that is owed to me by using a myspace blog. She also calls my children nasty names in this blog. The order prohibits all forms of electronic communication and threats. Does this count as violating the order? She also caused a significant amount of damage to my car the same day she posted the blog, but I don't have any proof. I filed a police report, but they don't want to do anything. The blog is still posted and can be used as evidence. What can I do? (I live in Phoenix, Arizona)

without proof she did it the police can't do much.
even if you know she did it with no whitness it's hearsay. it's sucks but that's how it goes
yes her posting on myspace is a violation.
print the postings and show them to court.
the police should at least write up the report as a domestic or harassment, or viopfa.
if the officers you deal with won't help you go to the lt or srgt and ask for a report for court purposes.
i would also report it to the courts so they can keep that on file also.
i would call the non emergency # for your police and ask for a report. or stop in to the station if they take walk up reports.

I would print her blog for your records, but if she did not send it to you personally, she has really done nothing to threaten you or harass you. She is merely writing in a "live journal" that you can look at if you want. She can even come back and say that you constantly looking at her myspace page is kind of stalking like. There really isn't anything you can do to her if she doesn't physically contact you or email you with this. Her site is her personal property, you are not being FORCED to look at her page. She is not electronically COMMUNICATING with you, because she made no effort to COMMUNICATE it. She posted it on a personal web page as a blog. The judge will see that. But, there is nothing stopping you from suing your ex husband, or have him found in contempt of court for not paying his child support. Don't let her intimidate you, you do what you have to do for your babies.

The blog can be used as evidence, text messages on your phone can also be used. Keep going to the police keep making reports. Get your *** to the family court judge it's free the court will appoint you a lawyer and sue his *** for the back child support and get her for mental anguish. I would have her *** arrested for harrassment. what are you waiting for???

sorry to hear about your situation!! Unless she has named your children specifically, not just referring to them with nasty names...she can write whatever she wants (unfortunately)...and if there is no proof (other than your gut) the police can't do anything about the car damage- you can try to pursue it in civil court- but you have a fight on your hands.

Good luck

Call the judges office who signed the order and ask them why the police wont do anything. If they ignore you call them again and again. Be sure to have the names of the so called officers who wont help you before you do.

Do you have a Congressman's office nearby? If you stop by and visit, they are usually very helpful. (Don't write or call, that's a joke). Explain to them that the police are not being helpful.

It depends on if you are fearful, or angry. I suggest IF you are angry, that you document EVERYTHING. Get game cameras and try to catch her vandalizing your property. If you fear she may actually do harm to you- get a gun, and learn to shoot. Then, IF necessary, defend yourself.
