Im referring to companies that pick up a vehicle (from a bar) and drive it home for you, for a fee. What type of legal problems could these companies face and what safety precautions do they use? Also, what type of insurance do they require?

The might use his own car but company cars are a possibility. What is the better choice?

They use YOUR insurance.

If they wreck your car, they are driving it with your permission, and if your insurance doesn't cover it, tough. You probably have to sign a waiver of liability for anything but gross negligence or deliberate acts. I suppose you might try to challenge the validity of the contract due to your definitionally drunken condition, but since that condition led to the necessity of the contract, I doubt it would work.

The company probably won't be liable unless the driver doesn't actually have a driver's license.
