He got it out of the sorting hat. Apparently, Neville is a true Gryffindor as well. (:
YAY NEVILLE!

The goblin did take it. The sword can get pulled out of the hat by a true Gryffindor no matter who has it. Neville, a true Gryffindor, pulled the sword from the hat.

The sword was the rightful property of Godric Gryffindor, as Rowling later revealed in an interview... the goblins' claim that any goblin-made object should be returned to the owner after the original purchaser died, is simply biased and false.
Since the sword belongs to Godric Gryffindor, it is therefore available to any true Gryffindor if their need is great. The Sorting Hat was able to whisk the sword away from the goblin's possession since he wasn't the rightful owner, and Neville needed it.

The goblin did take it, but the Sorting Hat has the ability to transport Gryffindor's sword from where ever it may be to into the Sorting Hat for someone who needs it to pull out.

Any Gryffindor truly in need can get the sword, and this power was greater than the goblin's false claim to posession. Neville was in dire need of the sword, and so it came to him, just as it did to Harry in the 2nd book.

Longbottom drew it from out of the sorting hat, after Voldemort tried to put it on his head and set it on fire. As Dumbledore always said, help comes from Hogwarts to those who need it.
