Lets take the example that the kid found his father's gun and for some reason he shoots his parents.
What would happen to him? He's too young to go to prison?
What would he grow up into? a remorseful person? something else?

Lets also consider the child as handicap-free, the child may have felt mistreated but there are no significant signs of it.

For 45 Cal(...): don't worry I'm 21 and love my parents, wouldn't even think of killing someone.
The question just occured to me last night, what would happen if a kid did that kind of thing.

Children this young have killed. Sometimes their parents, sometimes, as in the case of James Bulger, 2 ten-year olds killed a two year old.

Children who kill are rare, but make for interesting psychological and sociological study. For an interesting look visit:

No child under 14 has been even tried as an adult. All states mandate that children 17 or under serve in a juvenile facility until they reach age 17, at which time they can be transfered to an adult facility. It is unlikley that a 10 year old will be tried as an adult. A court ruling would be required to for a prosecutor to do so. It would have to be proven that the child understood the ramifications of his/her actions and possesed "malice of forethought", meaning an understanding of his/her actions and malicious intent. If not tried as an adult the child will upon conviction in family or juvenile court be remanded a juvenile facility until not later than the age of 21.

My second cousin shot and killed his father when he was 14. The DA tried to have him tried as an adult and failed. He was remanded to a juvenile facility until he turned 18 and then released on probation for 10 years. There was proof of physical and emotional abuse occurring and that was a factor in his sentencing.

He is not to young to go to Juvenile detention and most likely would stay there until he was eighteen years old. At that time some states would consider releasing him, however most would transfer him to an adult facility so he could play with the big boys. That's where they will bust your teeth out when you arrive so you can't bite down.

He could be charged as an adult, depending on a number or circumstances, and spend the rest of his life in prison.

If he were charged as a juvenille, he would remain in a mental health facility until he is 21 and then re-evaluated to see if judged sane and ready for society, or to remain in the facility indefinately.

He would go into foster care and probably be closely monitored psychologically.

And to some of the other answerers, yes he is too young to be sent to prison or even be charged as a juvenille.
