My ex-sister in law grabbed my brothers cell while arguing in a bar and destroyed the phone. Unfortunately the phone was actually mine. Is there any kind of legal action I can take against her to get repayment to replace my personal property?

You would be well off in purchasing cell phone insurance at the time you buy one, which will cost another $40 approx. if you file a claim with your carrier to get the replacement. Personally, if you are not going to keep your cell phone for "Personal" use to yourself, consider this: "S" kinda things happen!

Destruction of property may make your ex-sister-in-law liable for the tort of conversion. Take a look at the link below, and then visit your local courthouse's self-service center for small claims court to initiate a claim.
