His medical bills totaled about $700 from an allergic reaction. Claims he told the order taker multiple times that he is allergic to cheese. McDonald's offered to pay the bill, but he's pursuing a lawsuit. Think he should get the money?

No different than people suing the tobacco companies for their use of cigarettes. Granted, the tobacco companies did admit that they added additional ingredients to their tobacco. But, the companies didn't force those people to smoke that was their choice.

I was a smoker for over 20 years. I was aware of the risks, but i chose to smoke. The tobacco companies didn't force me to buy a pack of cigarettes or demand that I lite one up, that was completely my decision. It was also my decision to quit or not. Which I did. Now, if I end up with lung cancer ten or twenty years down the road, then that was my fault, not the tobacco companies.

Just like this guy here, he knew the risk of the possibility of cheese being on the product. He should know that their main menu consists of cheese products. You would think he would check before he decided to eat the product. My kid doesn't care for cheese. For years I have had to request no cheese on the hamburgers. I can't count how many times I have had to take the sandwich back because someone in the back couldn't read the sign "no cheese." But, I still keep checking before I serve the burger to my kid. Guess what, maybe he needed someone to check his food for him.

Unless he has video evidence of him ordering the "hamburger" and then getting a "cheeseburger," he will be hard pressed to get anything. My question as a juror would be "If you are allergic to cheese, why did you not look to see that the sandwich was free of cheese prior to eating it?" Also, specific to McDonald's, the cheeseburger sandwich wrap specifically says cheeseburger and the slice of cheese that is placed on the sandwich is bigger than the burger patty and bun, so there is no way that you would not notice that there is cheese on the sandwich. While we all have gotten our order wrong at a fast food (or any) restaurant at some point in our lives, I would believe that if something that may be an allergen to my body could possibly be in my food I would check before just consuming it. This lawsuit is just ludicrous.

I don't believe he should get $10 million. No one deserves that much.

I can't find the answer to a few questions though. Was this one bite that did this to him or did he eat the entire hamburger? If I was that allergic, I believe I would avoid fast food places, mistakes can be made.

Remember that lady at Wendy's that planted that finger there and sued; then the store found out and countersued her and won? I have a feeling that's what this guy did; he prob put a piece of cheese in it so he can get millions of dollars, as if he's never been served cheese before.

I personally hate people that sue other people or companies for their own personal gain. I mean seriously just because you had an allergic reaction to cheese... dones't mean you are entitled to $ 10 million dollars. If the man continues to pursue the $10 million dont be surprised to find him dead. Dead like murdered!

No, he could see the cheese, and if he is that allergic and didn't check to make sure the cheese was off, then he isn't very smart and is looking for an easy ride.

I think he should get a little more than what this total medical bills were, but not $10 million, that's a bit much!

no because he should have looked before he took a bite, if there was a chance of it being there he should have been more careful?He does not deserve 10 million dollars! By the way, can't you usually see cheese on hamburgers?

SWEEET! Why didn't I think of that. They already got nabbed for serving hot coffee that was (duh) hot, now a cheeseburger with cheese! He didn't look at the burger? WTH! Unfortunately the customer is as much to blame as the employee serving him....but the billion dollar pockets are worn by Ronald McDonald. no way he deserves a 10 million dollar payout

that totally happened to me!! i told them to hold the mayo and they gave me mayo anyway. im sure it was due to a language barrier. but i ended up in the hospital from an allergic reaction. no lawsuits though. just complained to manager and guys was fired.
