I was having transmission problems with my vehicle and took it to a local shop for an estimate. They told me how much it would cost for repairs (well over $2000) and that they offer payment plans for people who cant afford to pay it all up front. I left that day to think about it and ended up taking it back on Wednesday August 8th, I was told at that point that my truck would be ready on Friday August 10th. Well Friday rolls around and I am told it isnt done but I would be able to Pick it up Saturday August 11th. Yup you guess it Saturday comes around and it still isnt done. Well here it is Tuesday August 14th and I went to pick up my truck and they have it back on the rack...so I ask what is going on ? He says they JUST took it out for a test drive and something else is wrong with it and I wont be able to pick it up. My question is since I never signed anything for him to do the repairs. Can I pick my car up and tell him I'm not paying him anything ?

I cant trade it in because I just bought it in February and It is a 2004 I owe way more then $2000.00 on it. He also Claimed he had all the parts in stock so that is how he was able to complete the job in 2 days. If you cant keep your word then dont promise it to people!

I am positive I have not signed a thing!
As far as a warranty Ford only offers a 36,000 mile warranty. Convenient huh?

You will most likely need legal advise on this one. Consumer law for vehicle repairs vary a great deal between states. See if there is a Consumer Protection Bureau or its equal in your area and talk to them. You may even have to contact the Secretary of State in your capital and ask for the consumer protection department.

Are you sure you did not sign anything? If you signed a work order, they have a mechanics lien on your car and you will have to pay them for the parts and labor that they performed on your car. If you did not sign anything and they will not return your car to you, call the police to meet you at the shop and ask them to help you get your car back as you never authorized the repair work in writing. He has the option to sue you if he did indeed perform some repairs on the car, but if you did not sign a thing, you can get your car back today. He will be very angry at you so be sure and bring the cops with you to help you. It will become a civil case. I find it difficult to believe a mechanic would perform repair work without a written (signed work order) authorization from you

Unfortunately for you there is a law on the books that states that no mechanic or dealer shall knowingly release an automobile in an unsafe condition. A lot of dealers Will use this as a reason to do more work than is required. On the other hand, why are you in such a hurry? I would rather have it done right right than rush the job.

You can pick up your car because it is your car but you will still owe money for the parts installed in the car and the labor thus far. Better just to leave it. When I had my transmission replaced it took a week to get the parts and get it fixed. Two days doesn't seem like a reasonable estimate unless they already had the parts in stock. Give them a couple more days.

well you could try to pick up the vehicle, but I doubt they would let you. If they did work on the car and supplied parts, they can get a mechanics lein. This is different from a lein on real estate as they have to have possession of the car. If you think they cheated you, then you could file a small claims action. I would advise you to get it paid and get your car. 2000 for repairs....you should have traded it in. good luck

No. The shop would have the right to hold the vehicle if you do not pay for the repairs.

you should pay for the initial fix if he did it, but definately not for all the other tests and stuff, because you never asked for those. and yes, if you never signed anything, then it is probably okay to not pay him, but i would talk to a lawyer for all the little details.

Yes, imho you can pick your car without paying anything, but I'm not a lawyer though.
