do you need ink in your printer to scan something?

Printers do not scan.

Some printers have a built in scanner. If this is what you have, then, no, you don't need ink to scan. Ink has nothing to do with the scanning process.

Are you talking all-in-one or separate scanner and printer?

In an all-in-one you may need inks (or at least an empty cart) for the machine to pass self-check and be prepared to work. Depends on the type of all-in-one you bought.

Separate scanner and printer... hmmm, did I need to think that you had 'em separate? Nope, I didn't.

I dont think so. As long as you are scanning it onto the pc, you dont need ink.

Unless some idiot has designed it such that it will not do anything if the ink is low.
