hello all- i have been out on bond for over 3 years now and recently(thurs 9th) the state atty requested a hearing to advise the judge that my bond had expired as of 3 years ago(may 23rd) with the hopes (i'm sure) that the judge would send us back to jail and have to bond out again- didn't happen the judge acknowledged that the bond expired and i am out on R.O.R.but now the bond agency still will not release the lein on my friend's house- even though florida statute 903.31 states that bond expired after 36months- do they have the right? what do i do to get this bond agency to release the lein? my lawyer is out of town for a week- anyone have any legal advise?

they helped you out when you needed it help them out and at least pay what they had to put up

The bond is expired for three years, but you can't wait a week until your lawyer returns? har har!

Anyway, if the bond agency is owed any money or has any possible future liability to the court, they will not release the lien. Out on ROR is not the same as being free and clear. You need your lawyer to look into it.

Your friend may be the one who will have to file a lawsuit to release the lien if all of the conditions have been met.

Assuming the amount you owe them for issuing the bond has been paid in full, stop in and show them the results of the last hearing. Ask them since the bond has expired to revoke the bond. Then they should clear the lien.
