My mom is being charged with embezelling $250,000 from a large insurance company. Her boss (an older, very wealthy man), used company credit cards to buy her outfits for company trips, bought her a pool and hot tub for her yearly bonus with the cards, and when the company found out, he said he had no idea about the charges. She has like, 30 something counts against her, alot of them she has actual receipts for legitamite purchases, but if she goes to court, each count could cost her 3-6 years each. She has receipts for about $20,000 of the purchases that she hadn't turned into her boss yet (for stuff like copy paper that they're charging her for!), and there are people thatsaw how her boss bought her gifts, but the risk of a high sentence is too scary to go to court, so she's signing a plea bargain. The plea is for 18 months. I'm 17, my brother and sister are 12 and 8- do you think the judge will sympathize and give her a lesser sentence? Shes a great mom and never even had a ticket.

He also doesnt work for the company anymore (we dont know if he was fired or what happened). I know she should go to court, but its just too scary to risk even being convicted of one count is minimum three years. If it wasnt for use three kids she would go to court and risk it, because she wants to prove her innocence, but we're all really attached to her and our lives would be devistated if she went to jail. Im hoping when we all go to the sentencing the judge will let us talk about what a good mom she is and how she runs everything in our home and maybe she'll come down easy on her. I know she shouldnt have accepted the gifts, but her boss was always generous with everyone and she was naive. But she didnt do anything maliciously, like take someones retirement money, she was just stupid. I mean, she should do some community service, or maybe pay back the personal stuff, but they're trying to nail her for stupid stuff from office depot...it sucks.

I hate to be a downer here... but if she knew how the gifts that he gave her were being purchased, she's not all that innocent. And by signing a plea bargain, I would say that she knows she isn't all that innocent too. She should have thought about you kids while this was going on. You shouldn't have to shoulder this stress. I am sure you will be fine, I just wouldn't get your hopes set to high on that judge being in a good mood. This is a big deal and I have worked in offices for about 15 years and in that 15 years, I haven't spent a total of $20,000 on office supplies unless you count the machines!

Does her lawyer have not have been given any backbone? Come on! If she's have been given the products on her boss being the embezzler, then the lawyer needs to be going to the mat with the decide to get her a deal to testify against the boss in substitute for immunity, or a minimum of a fabulous lighter sentence than 18 months. The boss is a sleazeball and merits to take a fall for it, noticeably pondering how the S.O.B. is disclaiming all understanding of the region and leaving your mom putting out to dry. If he would not do some severe time himself, i'm hoping he gets hit via a truck or some thing. Sheesh!!

were they dating? I bet she dumped him and this is why she's being charged! all the reciepts should back her up and if there was anything between them she needs to let the courts know. I'd also have your mom's lawyer seriously check into the old man's finances, maybe he's got off shore accounts who knows??? normally I side with the guy and the elderly but this heel is runing an insurance company and it does look like hes doing your mom wrong SO I hope she winds up screwing him to the wall!OOOOOOO please try not to worry. the best thing she can have on her side is the paperwork. also, if you both know shes innocent why not get the media in on it? have the networks and the papers interview her and do a story on it, get NOW to defend her. the state women's business association might be willing to help. If you dont believe the devil didnt create anything he created the following:
1) insurance companies
2) baggage retrieval
3) customer service
4) the yankees

If she is innocent, she should NOT sign a plea bargain. She should tell EVERYTHING she knows, and she should SUE her boss for slander, libel, and defamation of character, even if it means she risks a longer prison time. I personally would NEVER agree to a plea bargain or confession of something I never did, but that's me. I also think that her boss should probably be investigated by the Board of Director's of the company, and that he might have a few problems of his own. If she is innocent and she knows it, she should NOT sign a plea deal - its admitting guilt where there isn't any. Good luck.

To start with a judge cannot change a plea bargain,he can reject it but he cannot change it,a plea is with her and the state,if the judge accepts it he is bound by what the plea says.I would think your mother got a great deal,If she knows where I can get 250,000 dollars for one and half years for that kind of money I would take it.I see people get that much for stealing a pair of socks,what is wrong with this country?Maybe they should send her home with a smack on the hand,and she could do it again.Let's see it will take me 12 years after taxes to make that kind of money.she is lucky she didn't get 20 years.

she needs to tell the truth and bring all receipts with her to the attorney she gets for her case. the court (judge) will want proof that someone else did this. but even if this Boss took the money and bought her things she would have to prove that she didn't know where the money came from. Someone had to sign for these things, they'll look at that also. who has their signature on these receipts for the pool and clothes? they will look at this. stores keep copies, so their attorney will get copies and find out who signed for most of this. this will be the guilty party that they look to.

I think if she has evidence to prove her claims, she should take it to court. I am sure that this is a case of sexual harassment as well. Your mother should sue the company and her boss for sexual harassment. Do not allow the government to intimidate your mother with large numbers, they do this so they don't have to take it to court. Do not allow your mother to become the scapegoat for her bosses misbehavior. Be aggressive, get a good lawyer and start throwing law suits everywhere or else, your mother will be pushed around.

Yes, don't worry about your mom. If the Prosecutor is offering a plea bargain, then she's already working out a deal. It might be rough for a little while, but you guys are going to be okay.

I think it will depend on the judge and if she has had prior convictions... but not to be mean, when you work for a large company and someone is buying you all kinds of stuff.. you should know its wrong.. no matter what it is..big or small.. but i wish you the best of luck and hope the best for you and your family...
