I recently caught up with a friend (born and bred Australian) who told me he was divorced and in a custody battle for the children from the union. I live in the US, and he told me he cannot leave the country as he'd be charged with kidnapping. Is this information true? If so, is there any hope that (once the courts have made the final decision about the little ones) that he could possibly move elsewhere (the US or somewhere else outside Australia) with (joint or full custody, for example) or without them and move on with his life?

Also, while all this is happening, is it required by law that he stay within the country of Australia or just within the state where the custody battle is taking place? Is it required that each parent stay in the country for court appearances, documentation, et cetera?
